Legal Question in Family Law in Massachusetts

My boyfriend has a 17 year old nephew that lives in MA. He has been in and out of trouble for the last two years. His father is not willing to help him out any more and he continues to kick him out of the house. His mother will not take him in either. He was told that this year he needed to repeat 11th grade. He has decided to drop out of school and get a job. My boyfriend and I live in SC and would like to try to get him back on track with his life. We would like to have him come live with us for this school year and try to give him a fresh start. My question is...Is he old enough to move in with us if both his parents say ok? Or will be have to go through court in order to hold temperary custody of him?

If both parents consent, he can move to SC and move in with you. At 17 he can also petition for indpendence.

If his parents are divorced, he may be entitled to force child support from both his parents as long as he is a full time student until 23 or completes college.
