Legal Question in Family Law in Massachusetts

My brothers girlfriend took their baby and will not allow him to see her. Is this against the law? And if he has damaging emails from her regarding hurting his family and he presents them to a lawyer will this help him get custody?

He needs to file a complaint for visitation. If he wants custody the court will exaimne the circumstances and decide what is in the best interests of the child. Don't wait.
