Buying assets during divorce

I want to start a divorce as soon as possible. We do not have any major assets now and pretty much agree on the terms. However, I want to look into buying a home or a vehicle. At what point should I start doing this so that they do not become marital assets subject to division? After the divorce hearing? after the NISI period? Any way I could do it during the divorce? Any suggestions will be appreciated.

You should engage an attorney and discuss this. As the new assets will be purchased with marital funds subject to division prior to divorce, the house will be a marital asset subject to division.

this is not saying you can't do this, by any means. However, you must do it right, and with a little care. "The best laid plans of mice and people in the midst of divorce oft go astray."

If you haven't already started divorce proceedings...it could take anywhere from 3 months to more than a year to get a divorce. If you and your spouse are both in agreement over the divorce and the agreement, then it will go faster. Either way, I would wait to acquire new property till the divorce has been finalized.

I would not buy anything until after the Separation Agreement is signed and approved by the court.
