Legal Question in Family Law in Massachusetts
name change of son
How do I go about changing my son's last name to mine. His father & I are not married, & doesn't see him. I was going to use my last name originally but when the showed up at the hospital 2 days latter we decided to use his name. He doesn't call or see his son and I am done calling him to let him know about his son. Thank you

You need to go to the Probate Court in your county (Norfolk, which sits in Canton). There, they will have the necessary forms. If you go on a day when there is a "lawyer of the day," you can get some help with the forms.
The father has to be notified with copies of the form, and he has the right to object. The court can allow the name change over the objection.

If the father agrees, it's simple. If he does not, you may have to file a petition with the Court.

You should also be filing a paternity action to establish paternity and a court order regarding the child's right to child support and visitation and custody orders as well as the child's rightful last name. Perhaps this would give the child's fater a more veted interest in his child.
