Legal Question in Family Law in Massachusetts
checks to a day care provider
My ex asked me to pay for half my childs daycare. No problem, BUT she asked me to give HER the money. She tells me that the ''day care provider'' is a friend of hers, and wants to keep the transaction ''under the table.'' I have been away for four months (where I am at there are no lawyers), so I decided to pay (by check made out to DAYCARE PROVIDER with my ex's name on the check using bill pay on the computer), the checks have been cashed by my ex, I have no way of knowing if my child is actually being taken to this day care provider. My ex has lied to me in the past, lied to the police in the past, and lied in court. I now think I was wrong to give my ex these checks, should I tell her I will continue to pay, but only directly to the provider? Could she be in trouble if she decieved me? I don't mind paying, but this is not part of our support agreement. Any advice would be greatly appreciated.

Re: checks to a day care provider
I believe it is within your rights to offer to pay directly to the daycare provider.
However, if this is going to cause trouble between you and your ex and you know she is very litigious, you might want to weigh that against the possibility that she'll want to pull you back into court just to complain.

You are not telling me if there is a court order. If this is not part of an order, you need not pay. If you have to or want to pay, make the checks out to the provider.
