Child is born in the us . parents are from india. How does this affect the divorce? My sister in law is in a bad shape and we are trying to help her out . My sister in law lives in massachuesetts. She is on a visa. her husband is working in MA. Can she get any public assitance to get a divorce ? My wife and I live in florida. She has no place to live. Can she file for a divorce from florida?

She files for divorce here. She seeks temporary support from her husband and child support. The husband cannot force her out of the home.
As to her ability to remain in the US, that is an immigration issue. Her child is a US citizen under current law, but she does not automatically get to stay.
