Child claiming right on tax refund

Does my ex-husband have the right to claim one of our sons on his refund even though the boys live me? He does pay child support

the issue of taking a child for tax purposes is dependent on your divorce decree, separation agreement or if neither of those things deals with the issue, then on the basis of who provides more than 50% of the support for the child. It is not unreasonable where two children are involved for each parent take one deduction.
