Legal Question in Family Law in Massachusetts

child custody

My boyfriend's 8 year old daughter has been visiting from south carolina since May 2007. He does not want to send her home because he feels there is some form of neglect on the mother's side. His daughter can not read or write and is home schooled. my question is, can he legally keep her in the state of Massachusetts where he is currently living...There was NO custody agreement involved in the case.....He never signed a agreement nor did she...they were never married....

Your boyfriend has no right to keep the child in Massachusetts unless he is awarded custody by the court with proper jurisdiction over the child. This is the South Carolina Court. He should seek a court order there. He would be best to get an attorney there to assist him.
