Child Custody

My daughter lived with her grandmother most of her life + she has physical custody.She now lives with her father for 2 yrs.We both have joint custody but she wants to come live with me in N.H. ten miles from where she lives in MA.She is 17 now do we have to go to A custody hearing because he does not want her to go?

Re: Child Custody

If no court order was entered giving the father physical custody, he has no greater right to physical custody than you do as the mother.

While a modification is technically a good idea, no judge is going to make a 17 year old live with a parent she does not want to, unless there are other issues (alcohol or drug abuse, etc.).
