Legal Question in Family Law in Massachusetts

child custody

I am a father of a 13 yr old son. His mother and I were never married. I pay child support every week and also have her claim him on her taxes. Money aside I feel that he would have a better livelyhood living with me. There are numerous issues in his household that make me feel this way. I am curious were I stand in the court systems. Not having stated all the issues in his home, anything we could tell me would be great. Thanks

If you have been involved in your son's life, the court will consider a good-faith modification claim. However, your son's desires are likely to be considered. The court will most likely appoint an investigator to assist it in the process. The best interest of the child governs these decisions. You need to be prepared for a drawn-out process, and one which may be costly.
