Child Custody

I gave up custody of my son to my husband as of our divorce 10 years ago. My life is much more stable now (never drugs or alcohol, just living arrangments were better with him) and now I would like to get custody back. My son also would like this. What do I have to do, Do I need a lawyer? I am not sure of the steps I need to take.

No matter how old your son is, you should not be discussing custody with him. This is a matter for you, your ex-husband and the courts.

THe courts will allow a change of custody IF it is in your son's best interest. Given your history, you would do best to have the guidance and assistance of an attorney.

Based on a change in circumstances, you could regain physical custody of your son or increase the visitation, if the court determined that it was in the best interests of the child. You could seek this change yourself, but I would recommend that you obtain counsel.
