Child Custody
My son went to his dads for the first 5 months of the school year, which is the longest length of time he has spent with his dad, because I retained custody of the child.
His grades dropped, and he wanted to stay with me, so when he came home for christmas we discussed it between he and I (son and mother).
I researched the two differant school, the one he was attending and the one I would enroll him in, and found the ratings to be slightly better. I discussed the fact that I believed our son was better off here as far as education and any needed special attention he should need.
He came back from his dads angry and sad thinking he would have to leave, which I believe was a big factor in his educational problems, he wanted to be with his mom, and step-dad whom basically raised him.
Now his dad and dads mother have informed me that they are going to take me to court. I had problems in the past concerning alchohol and marijuana, which isnt an issue now, and hasnt been for a while. I also spent time in a mental fasility for postpartum depression.
I am concerned that these factors may be a problem and his father will get custody of my son.
What would be the best advice for a mother in this situation?

Get an attorney to help you, as this is not a one-shot deal in court.

You need to retain an attorney. Child custody is not a simple one time thing. However, depending upon the age of your son, he will have some if not significant input into where he lives.
Also, I would talk to the physicians who helped you with your former problems to make sure they will support you should you need them to do so.
