Legal Question in Family Law in Massachusetts

Child Custody Unwed parents

I am mediating a custody agreement between my brother and his girlfriend. I have covered visitiation, child support, insurance, holidays, and education. The visitation however would go to my parents not my brother because of his past with narcotics ect. All parties agree with the agreement but will an explaination of why my parents would have custody during visitations have to be addressed and to what extent. I did not want to put anything in there that would hurt him in future custody issues should they arise. The mother of the child is concerned about his past behavior and wants to protect the child, as do we. The mother is also in Florida and the child is here because we got an order to prevent the child from leaving the state. What is needed in an affidavit explaining why she would not be there for the hearing. Does anything else have to be done to speed this through? They want to resolve it as soon as possible.

Re: Child Custody Unwed parents

I am concerned that you are practicing law or social work without a license. What has to be done to speed this through is that you need to have your brother engage a lawyer to fully advise him of his legal rights. His girlfriend should do the same.
