Legal Question in Family Law in Massachusetts

Child Custody

My five year old step-son lives with his mother and my husband and I get him almost every weekend. He cries when its time to go home and always tells us that he wants to come live with us. I wasn't sure what legal age was for a child to choose which parent he/she wants to live with?
