Legal Question in Family Law in Massachusetts

Child Custody/Removal Laws

I am a mother planning to move out of state with my daughter, who is 3, and was wondering what type of Removal Laws apply to me. I have never been married to the father, or had any type of legal agreement concerning child support or visitation, although he has sporadically given me money and taken her for a night on the weekend. I know that in this situation I have sole legal and physical custody of my daughter. He has had a very minimal relaitonship with her, and I would like to avoid going to court. Can I leave the state without obtaining permission from a Judge? Thank you.

Re: Child Custody/Removal Laws

It depends. If you have never been to court, and there is no court order related to the children, even a child support order, custody or visitation orders, then you are probably able to move.

However, if there is any court involvement that you may be required to seek the court's involvement.

This is a complicated issue, and feel free to contact me about this issue.
