In Massachusetts the law says the grandparents have rights. Is that only if the father is not involved or the grandparents can get visitaion on top of the father having visitation?

Grandparent rights are very limited. The initial filing requires a "threshold" showing before the case can even go forward. This conforms to a decision under the Federal Constitution that provides fit parents the right to exclude all the world from visitation. You should get an in-office consultation regarding your precise situation. You should not seek this relief on your own due to the requirements.

The court, on appropriate motion with notice to all concerned, may grant grandparent's rights in addition to the rights of the biological father.
