Legal Question in Family Law in Massachusetts

child in high school age 18, mother moving out of state but still maintaining pl

child is in high school and mother is moving to a state 3 1/2 hrs away for job but still will be maintaining the rental unit for the son.The mother will be returning frequently . She has older child of 21 living there to supervise. Older child has a baby and babies dad also moving in. They are only paying partial rent to suppliment the mothers rent. This is to insure that 18 year old has someone there. The 18 year old wants to complete high school in his school and could not emotionally take moving to another school at this time. Can the father stop child support on the basis that he consideres that at 18 and since mother will not be ther full time, emancipated? the 18 still is totally dependent upon parental support and has one more year after this before graduation from high school.

You can only stop support if the court orders allow you to stop support. Read the judgment that is in effect to answer this

question. If you are asking about a modification, it sounds unlikely that you could get a modification as long as the mother is

supporting a child under age 23 who is in school.
