Legal Question in Family Law in Massachusetts

child removal

My court order states I have sole legal and physical custody of child. Father has visits at my discretion. I've never stopped him from seeing our son but he's made the choice not to in months. I'm trying to move to FL. at end of school year for several legit reasonable reasons. Ive left visits open for father and will continue to do so although he makes no attempts. Can I just move out of MA. or are there legal things needed to be done first?

You may need to file a complaint for modification seeking the Courts approval based on legitmate needs of the child. Good Luck!

You need either the Father's written permission or the courts permission prior to moving. If you can't get the father's permission, the court usually allows such moves for valid reasons.
