Re: child support

If Massachusetts retains jurisdiction over the Child Support and you reside in NC you can retain a Massachusetts attorney to pursue a Modification Complaint in the Massachusetts Probate and Family Court, if that is your question. Good Luck!

Re: child support

M.G.L. c. 209D covers the jurisdiction for handling support. It can get confusing. IN GENERAL, Massachusetts remains the appropriate state for ordering child support if either parent or the child remains here -- UNLESS the parents BOTH agree to move the case to another state.

Without knowing whether you are custodial or non-custodial, I cannot give a recommendation about whether it makes sense to agree to move the support case out of Massachusetts. For the custodial parent, Massachusetts Guidelines and age limits are highly beneficial -- they provide for more support to the child for a longer period of time. Thus, I would recommend to any custodial parent to continue Massachusetts child support whenever legally possible.
