Legal Question in Family Law in Massachusetts

child support with 2 children in college

I have twin daughters who will be graduating next year. They will both be going to college and still living aat home. Does their father have to continue paying child support?

If your divorce judgment does not specifically deal with this you may need to retain an attorney to file a Complaint for Modification. Good Luck!

Yes, they do. However, you should have an attorney review the judgment in effect to see if it needs to be brought "up to date." If DOR/CSE is collecting the support, it sometimes terminates its collection because the old wage assignment did not specify that the child support continues through age 21 or 23. To remedy this, a modification action is required. You should file the modification in advance.

In addition, you should be aware that the revised Guidelines state that they do not apply automatically after the child completes High School. You need to get your Financial Aid ducks in a row sooner than later to make sure that all is handled appropriately.

If your separation agreement is silent on the issue, you need to file a Motion for Modification and seek not only continued child support but contribution for college.

I would check with my divorce attorney or contact an attorney to assist you.
