In 2002 My husband was ordered to pay child support to the youngest of two children of his previous marriage. In 2003, we were planning on moving to Guatemala where my husband is from, so my husband, his ex, her boyfriend at the time, and myself all sat down to talk about the children & support. They came to a verbal agreement that the eldest son in Guatemala which my husband has solely provided for in 12 years would be his responibility, and the youngest, she would support & have custody of him. She, the ex said she would let the court know, & we didn't have to worry. Now we are back in the U.S., and the eldest son is in the process of recieving his papers to come join us. The ex took my husband to court last week claiming child support for the youngest from 2003 to now totaling $ 19,000.00. They had a verbal agreement, she is illegal here, and she hasn't paid a cent to their other child which my husband has supported for 12 years. In court the judge wouldn't let my husband talk, & he went to jail. How can we fight this injustice? My husband would also like to fight for custody, the ex even admitted she didn't want kids, she is just keeping him for the money. Please help me, I don't know where to turn.

Verbal agreements modifying court ordered child support are usually not worth the paper upon which they are written.
