Legal Question in Family Law in Massachusetts
child support
my daughter has just left her boyfried they were together for 5 years. He had many affairs the last being a threesome with her next door neighbor. She has thrown him out and now he is saying he paid over $100,000 to her home during the 5 years and that if she doesn't accept $140 per week in writing he will lie to social security which she has been on for over 7 years due to many health issues that she isn't disabled he told her he didn't care if he lied. She doesn't want a problem with a disruption in payments. My thought is she should call ss and tell them of the threat. Also the $300 per week he gave paid for all his bills, including car insur which was greatly increased due to a dui. elec food heat internet cell phone home phone, etc. He never increased the amount after their child was born on 9/20/06. He used her second car for 4 of the 5 years and now is doing this as she took it back. He is saying he paid for repairs, however, he never paid anything for its use and put a great number of miles on it. He makes approx $60,000 per year and just got an apt for $1,400 and a new tv for $2200 and now says he can't afford child support should my daughter get a lawyer.

Re: child support
Yes, Your daughter should retain an attorney to establish paternity and a court ordered child support payment.
Re: child support
It sounds as though paternity and child support obligations have not yet been established by the court.
If this is the case, you should hire an attorney immediately and establish the proper child support amount in the probate court. Without a child support order, you have no recourse in the event that the father decides to refuse to pay.
Re: child support
Absolutely, she should get a lawyer.
If she would like to discuss this, contact me.
Re: child support
Your daughter should get a lawyer and seek child support. As to the SSI, the attorney can deal with that as part of the matter before probate to stop the false acquisations.
Good Luck to you and her.

-Oh-, should your daughter get a lawyer. -Absolutely- she should get a lawyer. I presumably join my brother attorneys here in offering my services, and add that your daughter qualifies for my reduced rates as set forth on my website.
Also, I have some experience with SSDI, and would certainly be happy to assist with that issue.
Please feel free to contact me, or any of the other competent attorneys who have already responded.
