Legal Question in Family Law in Massachusetts
Child support before filing
My wife and I are planning on divorcing soon. She will be filing in Dec.
I moved out at her request and have my own place. we have a 2 yur old that lives with her.
Prior to any proceedings what should I do for support? Do I need to pay her anything a month? should I pay for all my sons exspenses until the proceedings are done? She will have him 80% of the time while I will have him 20%. This included overnights. He is my son, im not going to not support him. I also want to make it look good to the courts that I care and want to make sure he is taken care of.
She looked at the main support page for Ma, she figured out how much I should be paying her. She thinks I should pay her that now.
Thanks
JK

Re: Child support before filing
You can calculate support using the Child Support Guidelines which are available on the Department of Revenue Web Site. You should check her calculations, and then, by al means, go ahead and start paying, even before the divorce. The Court can assess you for prior support when you finally get to court, so might as well begin to pay now. If you need further help, let me know.

I agree in part. Your goal should be to make this divorce as friendly as possible. Payment, should be considered carefully, and must be examined in light of the facts of your particular situation. Payment, if any, should not be made by cash - it should be made by check.
If she is going to file for divorce, you should plan for it, and consult an attorney ASAP. You are welcome to cotnact me for a free consultation.
