Legal Question in Family Law in Massachusetts

Child support guidlines for Teens

If children are ages 20 (full time college student), 17 and 11. No increase in child support for 6 years and over the 6 years non custodial parent has 10% increase in pay making an additional 6,000 a year and child support has never changed. Do teenagers get a percentage increase in support when they turn a teen and if so what percentage?Or does only the oldest get an increase? If 17 year old at the age of 13 turning a teen never got the teen increase is he entitled to it now and if so is it retroactive?

Re: Child support guidlines for Teens

You should retain an attorney to file a Modification Complaint ASAP as you are entitled to an increase that will NOT be retroactive but prospective from the date the Modification is filed. Good Luck!

The new child support guidelines does not take into consideration the age of the child. It simply takes into account the income of both parents and the number of children being supported.

You are definitely entitled to a modification order since your order is older than 3 years old and there is a 10% pay difference.

However, the child support order, if increased, will mostly likely NOT be retroactive.
