Legal Question in Family Law in Massachusetts
child support hearing
the DOR filed for a child support modification on my behalf back on Oct 14 2007. The court date has finally arrived.. tomorrow. The letter for the date arrived on Jan 15, nearly 2 months ago. My ex-wife hired an attorney less than a week before the date who has filed to have it postponed. It is a simple modification hearing to have the amount lowered to the guidelines, it is currently about 3 times what it should be. My questions are
1) Am I wasting my time even bothering to go as they are going to postpone it no matter what I say? I feel it should be resolved tomorrow. 2) My DOR case worker said to me I should try to have the new amount applied retroactively to Oct so my arrears aren't so bad. I am currently about $5,000 behind since this has taken so long to address and I wondered if having it adjusted retroactively is even something i have the right to argue.

Re: child support hearing
You should definately show up at the assigned time tomorrow. When you show up on time and dressed appropriately, it shows the court that you're a responsible dad and a good guy. That gives them more of an incentive to rule in your favor.
Do you have an attorney to represent you? Is DOR going to have an attorney there with you?
