child support

my husband has a 11 years old doughter, who currently lives with her mother. Last year he got a court approved mothers signature, that she wont seek child support from him. Now he is on millitary leave and she submitted to court to seek for child support. Hi will be back April/May.

Is this legal to ask for child support when she had signet a papers that she wont to ask for support. I have a court hearing this Thursday. How can I posponded this?

By a "court-approved mother's signature," I think you mean a stipulation which was approved by the court.

Without knowing what the stipulation was, it is impossible to advise you. So just remind the judge of the stipulation.

I am also assuming by "military leave" you mean

he is one of the reservists serving overseas.

If so, the court probably cannot act against him

until he returns from his tour of duty. So be sure to tell the court that he has been called up to serve overseas and is not expected to return until April or May.
