Legal Question in Family Law in Massachusetts

Child Support and Jail

Due to extenuating circumstances,I am currently in arrears of child support obligations in Massachusetts in the sum of 7,000. I have just obtained work and have started making payments.A week ago, my ex filed a contempt complaint, saying I am not paying to thier satisfaction, that the arrearage is too big etc. What are my chances of seeing jail time?

Your debt is considerable. The judge will look at what you have been doing, and why you have not paid. If you were unemployed or someone incapacitated, you should have filed for modification of child support. This is still possible. You should not go to to court unprepared or unrpresented.

You need an attorney. The facts you sent are not adequate to make an informed response.

My general rule is that if you don't pay child suport you go to jail. Also, some support for the child is better than none while you are in jail. If the State of MA is the real plaintiff in this case, you need professional help for your hearing.
