Child Support

Hi,

My kids father has a court order saying that he will claim our 2 kids on his taxes and that any profit that he makes from claiming them, 50 % of that money has to go to me. My question is this:

This court order was set last year and is for his 1999 taxes in which he STILL has not even filed yet. He says he has up to 3 years to file his taxes if he is getting money back, but if he has a court order to pay money out of them, does this matter? What can I do to get him to file his taxes so he can pay me what he owes me?

Assuming there is a net benefit, the failure to file can constitute or be a basis for an action for contempt. Depending on the amount, you can determine the cost/benefit of an action.
