Legal Question in Family Law in Massachusetts

Child support modifcation

I've been divorced for almost 2 years. At that time my ex-wife was not working. She was awarded alimony and child support for our 2 children (now 13 and 18). The CS was below guidelines because we applied the first $100,000 of income to CS and the remainder to alimony.

Recently she got a job, so I filed for a modification to reduce CS support. She is arguing that I should be paying her MORE and is going to fight this at our pre-trial in several weeks. Moreover, the chidlren have spent more time (25%) relative to the original agreement.

I fear what the gender biased courts might do.

Given these facts, does anyone think she might get awarded more money based upon the aforementioned change of circumstances?

We are in Middlesex county and have Judge Gibson.

The child support issue is fact specific, and you must show a change of circumstances. DOR has a web menu that will allow you to calculate the approximate child support.

If you have questions or need assistance, call me.
