Legal Question in Family Law in Massachusetts

child support modification

I am the non custodial parent of a son who recently turned 18. I have paid child support to my exhusband since 2000. (2 sons were involved at the time, the youngest now turning 18 years of age this past February.) Mass DOR had been collecting the support through wage assignment and has stopped because the court order states that I pay support for ''minor children.'' I have fufilled my obligation according to DOR.

My ex has now filed a complaint for modification to extend the court order listing the reason that our son is ''principally dependent upon'' the father for support. This is stated by plaintiff (father) in the complaint for modification.

I received a copy of this complaint with an attached domestic relations summons dated 3/12/09 yet I only received it by regular postal mail service today, 4/8/09.

I have no idea what i'm supposed to do and cannot afford an attorney as I now have a 3 year old, I work part time for the Department of Homeland Security and I also pay $464. a month for Child care for my young daughter while I am working.

Could you please give me some advise?

Thank you.

Respectfully,

A concerned mother

Re: child support modification

You need to answer the Complaint for Modification and show up for any court dates.

Your ex is entitled to child support up to the age of 23 for the child if the child is residing primarily at home (dorming at college counts as residing primarily at home) and attending full time school.
