child support modification
I have been recieving child support for eight years for two children from my ex husband.My oldest is 13 now and I would like to go in for modification. I am remarried and would like to know if the court takes in to consideration my present husbands income.I am positive my ex husbands income is more than it was eight years ago. He owns his own business, hides alot of money. I have never taken him to court but now I feel its time to go in for modification. He pays 150.00 a week for two children. We are suppose to split the extra activities but it is always a struggle with him.

The amount of money a father pays for child support is determined by a schedule that involves his income and yours. Thus, your present husband's income is not part of the equation. The amount of child support increased when a child has reached the age of 13.

A father's child support is based on his income and yours, not your new husbands. Also, when a child becomes a teenager the rules provide for a Basic Support Order plus 10%. Over 18 it is descretionary with Court as to the amount.
