Legal Question in Family Law in Massachusetts
Child Support
Non-custodial parent pays weekly child support to mother who reside in Florida with 2 minor children (13 & 7 age). Massachusets court order does not say that father has to pay health insurance or braces or dental. Mother has not let father see children since last year, and is now telling father he has to pay 50% of 13 yr old's braces and if he doesn't she is taking him to court in MA to have him pay. They both have joint legal custody, and father never agreed. What are the chances of him being ordered to pay for the braces, they were not a medical necessity. Isn't child support for the care of the children??

Re: Child Support
In my opinion, child support guidelines are not applicable when the noncustodial parent is not allowed to see the child(ren).
Did mom leave Mass with permission of the court?
Did you consent?
Did you have an evidentiary hearing?
You will have to fight like hell.
The court has deprived the children of their father by allowing mom to leave with them.
