Child Support Rules in MA
My husband has a son who lives in
Massachusetts with his mother. We
live in Florida. My husband was never
married to the other woman. We've
been paying monthly child support,
which has been agreed upon without
really any court involved. Now the
boy will turn 18 in two weeks and he
still has eight months until he
graduates from high school. My
question is, do we have to pay child
support until he graduates from HS
or or we done once he turns 18? We
definitely don't want to break any
laws, but we certainly don't want to
pay if we are not required is the child
turns 18. Your help in this matter will
be greatly appreciated. Thank you in

Without a court order designating child support you only have a moral obligation. If you have any more questions, contact me.

While you presently only have a moral obligation as stated by the previous answer, if there was a court order it typically would state that support would be paid until emanicipation which typically is when the child graduates from high school. However, if the child goes onto to college and is enrolled full time, you may be ordered to pay support until age 22. Of course, all this depends upon the circumstances and a judge would evaluate all the facts prior to issuing a decision.

At present you only have a moral obligation as previously stated. However, a court would obligate you to support the child iuntil he finishes high school. Moreover, the child can seek support as long as he is a full time student and can ask the court to have both you and the mother assist him in paying for college.
