Child Support
My son turned 23 on 4-24-2007. He is still in collage. He was to recieve his BS on 5-19-2007, but I was just informed that he failed 3 courses and won't be able to graduate. Do I have to continue to pay chil support and collage payments?

By statute, the court's authority goes to age 23 only, regardless of graduation, or one bachelor's degree, whichever comes first. Based on your question, the birthday will come first.

The Court can require you to pay support to each of your unemancipated children. A child is unemancepated so long as he is under the age of 23 *and* enrolled in an udergraduate program. Because your son is now over the age of 23, you have no further obligation to pay court-ordered child support, whether he continues with his degree or not.
