Legal Question in Family Law in Massachusetts

I had child support stopped on March 29, 2010, but the child support still kept direct depositing in my checking account. This went on for 4 months. I told my ex after the second check and he said he would take care of it, but it did not stop. I spent the money which was a total of $3,000.00. My ex wants the money back and has taken me to small claims court and won the decision. I wanted the deposits to stop, but i took 4 months. I do not feel I should pay the total back as was not my fault the money kept coming. No way it should have taken 4 months to stop; I feel he new what was going on and allowed it to continue so he could make me pay it back. Should I be liable to pay him back?

How did he win in small claims court???

Need to vacate the small claims judgement and move the case into family court.
