Legal Question in Family Law in Massachusetts
Child Support/Child Care Expenses
I am non-custodial parent of 6 month old infant. I pay child support of $145 wkly. Is my share of child care expenses included in this amount? According to Mass. child support guidelines child care expenses are not a separate support item and responsibility for them resides w/ custodial parent. I was feeling pressured and did not understand terms of settlement. I agreed to pay 1/2 of child care expenses IN ADDITION to the $145 wkly child support. I don't believe this arrangement is fair. Am I entitled to a modification of the support order. I believe the mother of the infant is responsible for the child care expenses. Also, she is in contempt for unjustifably refusing my visitation rights. Can I seek a reversal of the custody order based on this? Also, the mother of the infant is placing him in harm's way by knowingly keeping him in a living arrangement where there is illegal drug use going on by her parents. Any advice you can provide will be greatly appreciated. All this has been presented in court, and the judge has this under advisement. What does that mean, and should I do anything further?

"Under advisement" means that the judge will issue a written decision.
You should wait and see what the judge says before asking us whether he or she will be "right."

You have to wait for the Judge at this point. If you do not have an attorney at this stage and the judge rules against you, I suggest you contact one and plan your next move.
