Child Support/Lottery Winnings

Good afternoon,

I currently have an court order against my daughter's father for 155/week. We have been going to court for some time now on contempt of court through DOR. He currently owes me over $8,000. It has been three years of him paying when he felt like it. He agreed to pay me this sum within 120 days from today and continue paying me the 155/week. My issue with the situation is following the court case he told me he had won $1 million on a scratch ticket. He has not cashed the ticket in because of the court proceedings and states that if I try to have his payment increased, he will have a third party cash the ticket for him. He also mentioned that he was going to take the money as a lump sum. I am very sure that if he takes a lump sum, the money will be gone within 1-3 years. My fear is that once this money is gone, things will return to the way they are now. I will never know when I am going to receive another payment.

Ask the DOR Attorney to verify his lottery winnings, and whether they can ask the Court to require that a portion be set aside sufficient to set up an annuity for payment of child support until the youngest child's emancipation. Good Luck.
