Legal Question in Family Law in Massachusetts

Child Support/Sole Custody

I pay child support for my 3 kids (ages 11,8,& 3) that live with my ex-husband. I am paying 35% of my salary in support. He went from a management position to parking cars at a garage. He is underemployed and refuses to earn more money. Can I force him to get a better paying job? Or is there some way to reduce my child support payments? He keeps pressuring me to give up joint legal custody. If I do this, do I still have to pay support?

Re: Child Support/Sole Custody

You can't force your ex-husband to earn more money. You can ask the court to force him to do so. The court can order him to do a job search to find a better paying job. The court can also reduce the child support by imputing income to him. Joint legal custody does not affect child support. Giving up the joint legal custody won't change your support.
