Who has the right to take the child as a tax exemption?

If there is no written agreement, then the IRS rules control, If there is a written agreement, court ordered, then the order controls. If you have more specific information, I can provide a more specific answer; so please contact me.

Usually it is the primary financial caretaker and/or it could be set forth in a separation agreement. For example, if there are two children sometimes the parties will agree that each parent shall claim one child.
