Legal Question in Family Law in Massachusetts

children's health insurance

my ex has the responsibility to provide insurance for the children, we equally agree to share in all of the children's uninsured medical, dental and mental health costs. She wants me to pay 1/2 of their weekly coverage. That is not correct on her part, is it?

The Guidelines calculate your child support. Her child support includes 1/2 of the cost of the plan covering both herself and your children. Either she is incorrectly interpreting the particular terms of your separation agreement, or your own divorce attorney was incompetent. The first of these two choices is FAR more likely than the second.

Re: children's health insurance

The health insurance should have been included in your child support calculation, so I would think your ex is in error.

I would review your separation agreement or order, but it is highly unlikely she is entitled to what she is demanding.

You should consult your divorce judgment. It should say that she alone has the responsibility for maintaining medical insurance for the children according to your interpretation. If it says you must share the cost of maintaining the medical insurance for the children, then you must share it.
