Legal Question in Family Law in Massachusetts

My child's father lives with a violent man

I am divorced and have full physical custody. My ex left his lover after an argument became violent. He mentioned the possibility of reconciliation and I fear my child being exposed to this person during visitation. Is there anything I can do to prevent this person from being with my child when his father has his visitation?

You can seek to have the court condition visitation on keeping the lover out of the picture. If your ex obtained an Abuse Prevention Order, this would be a likelihood. If you have legitimate concerns that your child would be harmed during a visitation, you should seek to have the court enter appropriate orders via modification of the divorce judgment. Filing pro-actively is better than refusing visitation and facing a contempt action.

I am available for consultation in-office.

Your fears must be based on facts. If you believe there is a material risk such that there would be harm if your son was exposed to such conduct, then you should seek a modification of the visitation order.
