If the Mother has custody, you will need to file a Complaint for Modification requesting custody in the Probate and Family Court. The change in circumstances is the Mother's relapse and the safety of your child. If you would like to discuss your options in more detail, feel free to call me at 508-969-9988.

If you believe that it is an emergency, then you need to go to the Probate and Family Court and file an emergency motion for custody along with the Complaint for Modification.
