Legal Question in Family Law in Massachusetts

claiming a dependent on taxes

I am divorced and have 2 sons which I pay child support for. I have joint legal custody while my ex retains physical custody. In my divorce agreement I am eligible to claim 1 of my sons as a dependent on my taxes. However, my divorce agreement does not specify which tax credit I can or can not claim. Am I eligible for any and all tax credits that go along with claiming my sons as a dependent?

Re: claiming a dependent on taxes

If the agreement is vague, it needs to be changed by agreement or be presented to the court.

Direct this question to the attorney who repesented you in the divorce. Or retain an attorney to read and interpret the specific language of the divorce agreement/judgment. Good Luck!
