Claiming Dependents

When we became divorce I was unemployeed at the time and my ex was able to claim the children on taxes. Now I am working full time, carrying the insurance and pay for all the clothes, outside activities and medical costs. Can I go back to court and request to claim my child on my taxes? The child lives with me.

If you and your ex cannot agree to allow you to claim the exemption(s) you will need to file a complaint for modification and prove a material change in circumstances. Good Luck!

If you and your ex could agree to do so, you don't have to go back to court. If however, your ex still wants to claim the children and you two are in disagreement about it, then yes, you will have to go to court to get a modification.
