Legal Question in Family Law in Massachusetts

closing of order by DOR/CSED

I was receiving a child support bill every week from DOR/CSED. The bills stopped coming and they sent me back a check last November. My ex says I still have to pay child support even though I no longer get any bills weekly from DOR. Is this true? They told my ex that they consider my child emancipated- she is going to school part time ( but not a degree program). I have always only paid my support payments to DOR.

thanks in advance

Re: closing of order by DOR/CSED

You are obligated to pay child support until a Court says differently. The DOR has no authority to stop collecting, unless the Court order said "Child support shall be paid until January 1, 2002", or some specific date.

If you suddenly find yourself in "arrears" the DOR can seize assets, tax returns, and you can find that when you try to get your car inspected, they will refuse to inspect your car. You cannot modify child support retroactively in Court, only from the date you petition and forward. The longer you wait, the bigger the amount of money you may owe.
