community property /assets

I am getting a divorce. wife is living in our home and driving my car currently. house is in her name,car in mine? what rights do I have at this point as to them??

Mass is not a community property state.

While married, your wife is still with legal rights over some or most of the property.

The answer would depend on a number of things, including whether or not there are kids, where each of you work, how dependent each of you are on the car, and how the car was paid for amongst other variables. If you have a house together and/or children, you should hire an attorney to assist you and protect your rights.

The answer depends on whether this was her home prior to marriage and what if any contributions you have made. If the home was the marital home and what she contributed to support of your life as well and if you have other assets as does she. If the car is in her name, it will depend on why it is her name as opposed to yours and if you have your own car.

I suggest you get an attorney if you do not have one.
