What constitutes as child abandonment in Massachusetts? How much do you have to pay to file for it? My brother in law is married and has been for 20 years to his wife, over the past year she has been committing adultery to which she told me and 2 other people and also admitted it to her husband after he confronted her on it. He gave her another chance then caught her again in the bar with the guy he asked her to leave the house and she left with out any contact to there 11 year old daughter in days and is staying with the man she is committing adultery with.

Your brother-in-law should file a Complaint for Divorce or Separate Support and immediately file a motion for custody and child support of his daughter to resolve the matter. That is the best way for your brother-in-law to look after the best interests of his daugher.

It sounds like you want advice on a fault based divorce. Practically speaking, fault based divorces do not give any advantage. Your brother should file for a complaint for divorce, as mentioned above.
