Legal Question in Family Law in Massachusetts

Contempt of Court

I was awarded sole physical custody of my daughter two years ago. The childs mother was ordered to pay child support and to divide any uninsured medical expenses for the child. Also she was ordered to provide medical insurance for the child. Since quitting her job which supplied the insurance she cancelled it, complaining of high cost. I just started a new job which will enable me to gain medical insurance for my daughter within 120 days. My question is: If I decide to take her back to court on contempt charges would it accomplish anything?. Would the court make her pay a percentage of my insurance for my daughter? Thank you.

Re: Contempt of Court

A contempt is a noncompliance with a court order.

It must be enforced if the court order has any meaning.

Often the family courts ignore the contempts of women, but they have an obligation to find women in contempt as they do men.

File a contempt. Keep a records.

Get the tape of the proceeding or, better yet, have a court stenographer there. You want a record of what the court does.
