Legal Question in Family Law in Massachusetts

Contempt of Court Questions

I live in Indiana, my children live in Massachusetts. We have joint custody of the children. In our court document it says I will claim one child and she will claim the other every year on taxes. She claim both. What do I do? I did not claim because I filed electronically and they wouldn't let me. Also it says all medical decsions will decided mutally. She put oldest child on medication without consulting me, for ADHD, after getting multiple opinions and all saying no. What do I need to do? File contempt, do I need to get a attorney? Would I possibly be able to get full custody because of this?

Re: Contempt of Court Questions

You should file a contempt action in Mass.

As to the issues related to the children, if you feel she failed to consult you, then this can be part of the contempt.

The odds of a shift in custody on the facts stated = 0;

You should always consult with an attorney, and hire one, especially since you are in another state.

If you need assistance, contact or call me.
