Legal Question in Family Law in Massachusetts

contempt

How many times can a person file a contempt when they haven't proven it each time. at some point does the judge tell him to stop? my sons father doesn't always take my son, and then he files a contempt stating that i am refusing the visits. Meanwhile, he hasn't paid support in over a year, and all the judge says is when can you pay the money. I just don't get it. Is there some special wordings I need to be using? any help will be greatly appreciated.

Re: contempt

Next time he brings you in for contempt, file a motion for temporary orders motioning that the court consider ordering that the next time any of the parties file an unwarranted contempt, that the moving party be ordered to pay attorney fees and/or ask for sanctions. Good luck!

Re: contempt

I agree with Maria. You should have already asked for fees and costs in the prior contempt actions. You should also seek an order from the court that in future contempt actions, you are not required to file or appear, until and unless a judge reviews the complaint or motion for contempt.
